You are hereby notified pursuant to the authority vested in me as City Manager of the City of Minot, North Dakota, under Section 2-27 of the City of Minot Code of Ordinances, that I am calling a special meeting of the Minot City Council to be held in the City Council Chambers in City Hall, Minot, North Dakota, on Wednesday, January 17, 2018 at 4:15 p.m. for the purpose of holding an executive session regarding pending litigation – attorney consultation and discussion of potential litigation strategy and/or guidance for negotiation strategy/instructions, pursuant to authority of N.D.C.C. 44-04-17.1, 19.1, and 19.2.

CONSIDER ORDINANCE NO. 5260 ON SECOND READING- APPROVE USE OF SALES TAXES TO PURCHASE AND INSTALL SPECTATOR SEATING AT THE MINOT STATE UNIVERSITY DOME

On August 7, 2017, the City Council considered the request of Minot State University with respect to improvements and enhancements to the Minot State University Dome, a community facility located on the Minot State University campus in Minot, ND. The Council has given tentative approval for their finance request in the amount of one million dollars ($1,000,000) for the year 2018.  This one million dollar ($1,000,000) contribution in 2018 is contingent upon and subject to: (1) the passage of this Ordinance; (2) the execution and signature of a Joint Powers Agreement between the ND State Board of Higher Education and the City and approval of said Agreement by the ND Attorney General’s Office; (3) determination by the City Finance Director that sufficient funds have been collected upon the city sales tax which adequately fund the NAWS project and further permit distributions of the one million dollar ($1,000,000) sum for the improvements and enhancements at Minot State University; and (4) proof to the City Finance Director that, prior to disbursement of any monies by the City and no later than December 31, 2018, the North Dakota State Board of Higher Education and/or representatives from Minot State University raised an additional five hundred thousand dollars ($500,000) for the purchase and installation of spectator seating at the Minot State University Dome. 

On January 8, 2017 City Council moved to approve a joint powers agreement between the ND State Board of Higher Education and approved this ordinance (first reading) authorizing and appropriating, on a contingent basis, city sales tax proceeds derived from City ordinances 3560 and 4380, to the ND State Board of Higher Education, for the upgrading, remodeling, or construction of community facilities as permitted under Section 1 of Ordinance 4380.
